Alcohol Licensing Law

0%

Introduction

The Government of Jersey is seeking feedback on the proposed fee structure for alcohol licences under the new Alcohol Licensing Law, as adopted by the States Assembly.

The proposed fee model aims to

  • simplify the licensing system,
  • better reflect the new licence categories, and
  • create a more balanced approach across different types of alcohol sales.

This consultation seeks views on whether the proposed fees are clear, proportionate and suitable.

Background:

Jersey’s existing alcohol licensing system was established under the Licensing (Jersey) Law 1974. It contains seven licence categories, and some businesses are required to hold more than one type of licence for the same premises. Licence fees have not been increased in line with inflation since 2007.

The States Assembly has adopted a new Alcohol Licensing Law, which will replace the existing system with three principal licence categories:

·         On-licences, for premises where alcohol is sold for consumption on the premises;

·         Off-licences, for premises where alcohol is sold for consumption elsewhere; and

·         Event licences, for the sale of alcohol at events.

Under the new Law, an on-licence will also permit off-sales where this is allowed by the conditions of the licence. A business will therefore not need to hold a separate off-licence simply to offer takeaway alcohol alongside its main on-licensed activity. Businesses will also be able to hold licences for more than one premises under the same business entity. These changes should reduce the number of separate licences required by some businesses and make the licensing system easier to administer.

The introduction of the new licence categories means that the existing fee structure must also be replaced. The proposed model is intended to be simpler, to reflect the different scale and nature of licensed activities, and to maintain overall fee income at broadly the same level as under the current system
